Deputy Who Killed Man Put On Leave

An off-duty Arapahoe County sheriff's deputy who shot and killed a young man during a confrontation in Lakewood has been placed on administrative leave pending the outcome of an investigation.

The deputy, 49-year-old Daniel Montana Jr., apparently was on his way home when he and two young men in a pickup truck got into an argument Friday night at West Sixth Avenue and Indiana Street.

A fight erupted at the end of an off-ramp when all three got out of their vehicles and ended when Montana pulled a handgun and fatally wounded David Rossiter, 25, a passenger in the pickup, authorities said.

Montana, who was in his personal car and not in uniform, was treated at a hospital, booked and released.

He has been placed on administrative leave pending the investigation by Lakewood police and a decision by the Jefferson County District Attorney's Office, said Arapahoe County Sheriff Grayson Robinson.

Montana has been with the sheriff's department and assigned to the detentions facility since 1991, Robinson said.

The sheriff declined to discuss any commendations or complaints the deputy has received.

"I'm simply not going to," Robinson said.

A woman who answered the phone at Montana's home Sunday said he would have no comment.

A discarded cigarette butt that landed in or on Montana's car may have sparked the confrontation, said Lakewood police spokesman Steve Davis.

"There was a cigarette butt that was flipped," Davis said. "But we're not sure that's what started the argument."

Rossiter's companion, 24- year-old Michael Hunter, was arrested on suspicion of drunken driving, Davis said.

Davis said at least a half-dozen others witnessed the confrontation.

"We got several calls," he said.

Stephanie Kruer, an attorney for Rossiter's father, has urged police to file charges against the deputy.

"We are monitoring the situation very closely and staying in touch with the Lakewood Police Department. We are also doing some of our own investigation," she said Sunday.

Rossiter's death devastated his family.

"David had so much going for him," said his father, Charlie Rossiter of Sheridan, Mont. "He was an Eagle Scout. He coached a junior high football team last year. He had a smile that just radiated."

Rossiter was in Denver working for a company that builds concrete foundations for cell towers. He had been with the company for several years but had been in Denver only about 1 1/2 months, his father said.
